General Terms and Conditions (GTC)

Modeberg Bern – BEPO TRADING LIMITED

These General Terms and Conditions (GTC) apply to all orders placed via the website www.modeberg-bern.ch, operated by BEPO TRADING LIMITED (hereinafter "Modeberg Bern"). By placing an order, the customer agrees to these terms.

1. General Information
Modeberg Bern sells fashion products online. The offered products are shipped from Asia, mainly from China. These terms and conditions govern the rights and obligations of the parties in the context of online sales.

2. Orders
Each order is considered acceptance of the prices, product descriptions, and these terms and conditions.
After placing the order, cancellation or changes are no longer possible.
Modeberg Bern reserves the right to reject orders in case of disputes or full or partial non-payment.

3. Prices
All prices are quoted in Swiss Francs (CHF). Shipping costs are shown separately. Modeberg Bern reserves the right to change prices at any time.

4. Payment
Payment is made online by credit card, TWINT, or PayPal. The order is considered accepted once the payment has been confirmed.

5. Delivery
Delivery is made to the address provided by the customer within approximately 6 to 12 business days. These timeframes are non-binding and may vary.
In case of loss of the package during transport, the responsibility lies solely with the transport company; no refund will be provided by Modeberg Bern.
If a package is not picked up and is returned to the sender, no refund will be issued.

6. Right of Withdrawal
The customer has the right to return an item within 30 days of receipt at their own expense and after prior contact.
Items must be unworn, unwashed, and in the original packaging.
Returns are excluded for discounted items.

7. Retention of Title
The goods remain the property of Modeberg Bern until full payment is made.

8. Warranty and Liability
In case of receipt of a defective product or incorrect delivery, a replacement product will be sent if available.
A refund is excluded in such cases.
Modeberg Bern's liability is limited to the value of the order.

9. Intellectual Property
All content on the website is protected by copyright. Any reproduction, even in part, is prohibited without express permission.

10. Disclaimer of Liability in Case of Force Majeure
Modeberg Bern is not liable for non-fulfillment or delay of delivery due to force majeure events such as strikes, natural disasters, logistical disruptions, or pandemics.

11. Minor Deviations
Minor deviations in color, size, or processing between the product photo and the delivered product are not considered defects and do not entitle to replacement or refund.

12. Customer Responsibility for the Delivery Address
The customer is responsible for the accuracy of the provided delivery address. Modeberg Bern assumes no liability for losses or returns caused by incorrect or incomplete information.

13. Applicable Law and Jurisdiction
These terms and conditions are subject to Swiss law. The place of jurisdiction for all disputes is the canton of Vaud.
